Terms of Use

1. Acceptance of Terms

By downloading, installing, or using CryptArtist Studio ("the App") or by accessing our associated websites, including cryptartist.com, mattyjacks.com, and givegigs.com (collectively, "the Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Services.

CryptArtist Studio is operated from the State of New Hampshire, United States of America.

2. License

CryptArtist Studio is open-source software released under the MIT License. You are free to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the software, subject to the conditions of the MIT License.

The full text of the MIT License is included with the software source code and is available at github.com/mattyjacks/CryptArtistStudio.

3. Use of the Services

You agree to:

  • Use the Services only for lawful purposes and in accordance with these Terms.
  • Not use the Services to violate any applicable federal, state, or local laws or regulations.
  • Not use the Services to infringe upon the intellectual property rights of others.
  • Not attempt to gain unauthorized access to any systems or networks connected to the Services.
  • Not use the Services to distribute malware, spam, or other harmful content.
  • Not use the Input Logger feature of DemoRecorder to capture keystrokes or mouse events without the informed consent of all persons whose input is being recorded.

4. API Keys and Third-Party Services

CryptArtist Studio allows you to enter API keys for third-party services, including but not limited to OpenAI, Anthropic, Google, and Pexels. You are solely responsible for:

  • Compliance with the terms of service of any third-party API provider you use through the App.
  • The security and confidentiality of your API keys.
  • Any costs, charges, or fees incurred through your use of third-party APIs.
  • The content you generate or process through third-party AI services.

We are not a party to your relationship with third-party API providers and are not responsible for their services, uptime, pricing, or data handling practices.

5. User-Generated Content

You retain full ownership of all content you create, edit, or generate using CryptArtist Studio. This includes but is not limited to videos, images, audio, code, game assets, and project files. We make no claim to any content you produce using the App.

You are solely responsible for ensuring that your content does not infringe upon the rights of third parties and complies with all applicable laws.

6. Donations

CryptArtist Studio is free software funded by voluntary community donations through mattyjacks.com and givegigs.com.

  • All donations are voluntary and made of the donor's own free will.
  • Donations are non-refundable and may not be charged back. By making a donation, you acknowledge and agree that the donation is final.
  • Donations do not entitle the donor to any specific features, support level, or development priority.
  • No pressure, obligation, or expectation is placed on any user to donate. The App is fully functional without any donation.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. YOU USE THE SERVICES AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CRYPTARTIST STUDIO, ITS CREATORS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Services.
  • Any unauthorized access to or alteration of your data.
  • Any content or conduct of any third party on or through the Services.
  • Any loss or damage resulting from API key compromise or third-party service failures.
  • Any bugs, errors, or defects in the software.

9. The .CryptArt File Format

CryptArtist Studio uses the .CryptArt file format for project files. While we design this format to be permanently forward-compatible, we cannot guarantee that all features of future versions will be available when opening files created with older versions. We will make reasonable efforts to maintain backward compatibility as described in our documentation.

10. Input Logger Disclaimer

The DemoRecorder program includes an optional Input Logger feature that records keyboard and mouse events. This feature is intended for creating AI training data and software demonstrations.

  • The Input Logger is disabled by default and must be explicitly enabled by the user.
  • A clear warning is displayed when enabling this feature.
  • You are solely responsible for compliance with all applicable laws regarding keystroke logging, including obtaining consent from all persons whose input may be recorded.
  • We are not responsible for any misuse of the Input Logger feature.

11. Open Source Contributions

By submitting code, documentation, or other contributions to the CryptArtist Studio project through pull requests or other means, you agree that your contributions will be licensed under the same MIT License as the rest of the project.

12. Indemnification

You agree to indemnify, defend, and hold harmless CryptArtist Studio, its creators, contributors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Services or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of the State of New Hampshire or the United States District Court for the District of New Hampshire.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Services after changes constitutes acceptance of the updated Terms.

16. Entire Agreement

These Terms, together with the Privacy Policy and the MIT License, constitute the entire agreement between you and CryptArtist Studio regarding the use of the Services and supersede all prior agreements and understandings.
